Notice At Collection For Applicants Residing in California

International Dairy Queen (IDQ) (the "Company") is providing you with this Notice At Collection For Applicants Residing in California ("Notice") to inform you about:

  1. the categories of Personal Information that the Company collects about applicants who reside in California; and
  2. the purposes for which the Company uses that Personal Information.

For purposes of this Notice,

"Personal Information" mean information that indentifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a natural person that the Company collects about its applicants, who reside in California, in their capacity as applicants for positions with the Company.

The following are categories of personal information that the Company collects from applicants. Each category indicates the purposes of use.

 

1. Identifiers And Professional Or Employment-Related Information

The Company collects indentifiers and professional or employment-related information, including the following:

Personal Information Collected:

Indentifiers: real name, nickname or alies, postal address, telephone number, e-mail address, signature, online identifier, passport number

Professional/Employment Related Information:professional certifications, professional portfolios and employment history

Purpose of Use:

Recruiting:

  • To evaluate applicants' qualifications for employment with the Company
  • To communciate with applicants
  • For diversity and inclusion purposes
  • To arrange and manage Company-sponsored events
  • To create a talent pool for future job openings
  • For recordkeeping purposes
  • To review current employees for employee referral program

Monitoring, Security, & Compliance:

  • To monitor use of Company information systems and other electronic resources
  • To conduct internal audits
  • To condust internal investigations
  • To protect the safety and security of the Company's facilities
  • To report suspected criminal conduct to law enforcement and cooperate in investigations 

 

2. Personal Information Categories From Cal. Civ. Code 1798.80(e)

The Company collects categories of Personal Information listed in Cal. Civ. Code. 1798.80 (e) (other than those already listed in "Indentifiers," above) as follows for the corresponding purposes listed below:

Personal Information Collected: Photograph and physcial description

Purpose of Use: Security and safety compliance, internal indentification for onsite interviews (iLobby)

 

3. Characteristics Of Protected Classifications Under California Or Federal Law

The Company collects information about race, age, national origin, disability, sex, and veteran status as necessary to comply with legal obligations, including the reporting requirements of the federal Equal Employment Opportunity Act, the federal Office of Contracting Compliance Programs (applicable to government contractors), and California's Fair Employment and Housing Act. The Company also collects information about disability status to the extent an employee may need special assistance during emergencies from the Company or from first responders.

The Company also collects the following information (in addition to those listed above) for the following purposes:

Personal Information Collected: Race, age, national origin, disability, sex, and veteran status

Purpose of Use: The Company also uses this Personal Information for purposes including: (a) with respect to disability and/or medical condition, as necessary, to comply with Federal and California law related to accommodation; and (b) with respect to age, incidentally to the use of birth date for identity verification.

The Company collects this category of Personal Information on a purely voluntary basis, except where required by law, and uses the information only in compliance with applicable laws and regulations.

 

4. Commercial Information

The Company collects commercial information including the following:

Personal Information Collected: Products or services purchased, obtained, or considered

Purpose of Use: Reimbursement of travel expenses

 

5. Internet or Similar Network Activity

The Company collects information about employees' use of the internet or other similar network activity, including the following:

Personal Information Collected: Browsing history, search history, log in/out and activity on the Company's electronic resources, information regarding an applicant's interaction with an Internet web site, application, or advertisement, and publicly available social media activity

Purpose of Use: To monitor use of the Company's information system and other electronic resources or information systems, and to protect the safety and security of the Company's facilities

 

6. Sensory or Surveillance Data

The Company collects sensory or surveillance data, including the following:

Personal Information Collected: Voicemails, footage from video surveillance cameras, information form room sensors

Purpose of Use: Communication, to protect and safety and security of the Company's facilities and personnel through video surveillance, to record visual indications of occupancy for reporting purposes, to troubleshoot issues relating to room occupancy or scheduling conflicts

 

7. Non-Public Education Information

The Company collects non-public education information, including the following:

Personal Information Collected: Academic transcipts

Purpose of Use: Evaluate applicants' qualifications for employement with the Company and to conduct a pre-employment background check

 

8. Profile Data

The Company collects profile data, including the following:

Personal Information Collected: Information from behavioral and aptitude assessments

Purpose of Use: Evaluate applicants' qualifications for employment with the Company

 

9. Background Screening Information

The Company collects background screening information, including results of the following types of background screening:

Personal Information Collected: Educational diploma or transcripts

Purpose of Use: Validate education for background check

 

10. Preferences

The Company collects employee preferences information, including the following:

Personal Information Collected: Travel preferences, desired working hours

Purpose of Use: Evaluate the application for employment and for travel and event planning

 

Purposes Potentially Applicable To Any Of The Categories Of Personal Information Listed Above

The Company also may use applicants' Personal Information to facilitate administrative functions and information technology operations and for legal reasons and corporate transactions. These functions include, but are not limited to the following:

  • to manage and operate information technology and communications systems, risk management and insurance functions, budgeting, financial management and reporting, strategic planning;
  • to manage litigation involving the Company, and other legal disputes and inquiries and to meet legal and regulatory requirements;
  • in connection with a corporate transaction, sale, or assignment of assets, merger, divestiture, or other changes of control or financial status of the Company or any of its subsidiaries or affiliates; and
  • to manage licenses, permits and authorizations applicable to the Company's business operations.

 

Purposes Applicable to Personal Information Collected for COVID-19

The Company is implementing procedures for measuring the temperature of all individuals coming into the Company's facility and inquiring and observing whether any individual attempting to enter a Company facility has any symptoms of COVID-19 or related illness. Any individual, whether an employee or visitor, whose temperature is measured to indicate a fever, who reports having or is observed to have any such symptoms, or who has recently been in contact with symptomatic individuals will not be permitted to enter any Company facility.

The personal information collected includes: Medical and health information, specifically your body temperature and whether you have or display certain symptoms such as fever, cough, sore throat, shortness of breath, or any other symptoms listed by and updated by the CDC, whether you have recently been in close contact with anyone who has exhibited any of these symptoms, whether you have recently been in contact with anyone who has tested positive for COVID-19, and whether you have recently traveled to a restricted area that is under a Level 2, 3, or 4 Travel Advisory according to the U.S. State Department.

The purposes of use include mitigating potential spread of COVID-19 in the workplace and identify and inform employees of potential exposure.

The Company may be required to release personal information to worker's compensation, OSHA, Department of Health, or any government entity, if deemed necessary for reporting purposes.
